Presiden Telah Tandatangani (Perpres) No: 91 Th 2017 Tentang Percepatan Pelaksanaan Berusaha

JAKARTA ,03 Oct 2017-Dengan pertimbangan, bahwa perizinan berusaha yang diterbitkan oleh kementerian/lembaga dan pemerintah daerah untuk memulai, melaksanakan, dan mengembangkan kegiatan usaha, perlu ditata kembali agar menjadi pendukung dan bukan sebaliknya menjadi hambatan perkembangan kegiatan usaha.

Pemerintah memandang perlu penyederhanaan lebih lanjut perlu diatur dan ditetapkan kembali standar pelayanan pada kementerian/lembaga, daerah provinsi, dan daerah kabupaten/kota, melalui reformasi peraturan yang diperlukan untuk melaksanakan kegiatan usaha.

Atas dasar pertimbangan tersebut, pada 22 September 2017, Presiden Joko Widodo telah menandatangani Peraturan Presiden (Perpres) Nomor: 91 Tahun 2017 tentang Percepatan Pelaksanaan Berusaha (tautan: Perpres Nomor 91 Tahun 2017).
Dalam Perpres ini disebutkan, bahwa percepatan Pelaksanaan Berusaha dilakukan dalam 2 (dua) tahap, yaitu:

1. Tahap Kesatu, yaitu: 1. pengawalan dan penyelesaian hambatan melalui pembentukan Satuan Tugas; 2. pelaksanaan Perizinan Berusaha dalam bentuk pemenuhan persyaratan (checklist) yang dilakukan di KEK, KPBPB (Kawasan Perdagangan Bebas dan Pelabuhan Bebas), Kawasan Industri, dan KSPN (Kawasan Strategi Pariwisata Nasional); dan  3. pelaksanaan Perizinan Berusaha dengan menggunakan data sharing dan penyampaiangyang tidak berulang yang dilakukan di luar KEK, KPBPB, Kawasan Industri, dan KSPN;
2. Tahap Kedua, yaitu: 1. pelaksanaan reformasi peraturan Perizinan Berusaha; dan 2. penerapan Sistem Perizinan Berusaha Terintegrasi secara elektronik (Online Single Submission).

“Pelaksanaan tahapan sebagaimana dimaksud dapat dilakukan secara bersamaan,” bunyi Pasal 2 ayat (2) Perpres ini.

Untuk meningkatkan pelayanan, pengawalan, penyelesaian hambatan, penyederhanaan, dan pengembangan sistem online dalam rangka percepatan penyelesaian Perizinan Berusaha, menurut Perpres ini, dibentuk Satuan Tugas (Satgas), yang terdiri dari: a. Satuan Tugas Nasional;  b. Satuan Tugas Kementerian/Lembaga;  c. Satuan Tugas Provinsi; dan d. Satuan Tugas Kabupaten/Kota.

Satuan Tugas Nasional, menurut Perpres ini, mempunyai tugas: a.mengembangkan kebijakan peningkatan pelayanan, pengawalan, penyelesaian hambatan, penyederhanaan, dan pengembangan sistem online dalam rangka percepatan penyelesaian Perizinan Berusaha; b.menetapkan prioritas penyelesaian berusaha; c. melakukan penyelesaian atas hambatan pelaksanaan Perizinan Berusaha yang disampaikan oleh Satuan Tugas Kementerian/Lembaga, Satuan Tugas Provinsi, Satuan Tugas Kabupaten/Kota, dan/atau Pelaku Usaha; d. Menyampaikan laporan kepada Presiden mengenai Perizinan Berusaha yang tidak diselesaikan oleh menteri/kepala lembaga, gubernur, dan/atau bupati/wali kota; dan e. Membentuk layanan pengaduann dalam rangka percepatan penyelesaian Perizinan Berusaha.

Susunan keanggotaan Satuan Tugas Nasional adalah: a. Ketua: Menteri Koordinator bidang Perekonomian; b. Anggota: 1. Menko Polhukam; 2. Menko Kemaritiman; 3. Menko PMK; 4. Mendagri; 5. Menteri Keuangan; 6. Menteri Hukum dan HAM; 7. Menkominfo; 8. Mensesneg; 9. Menteri PANRB; 10. Kapolri; 11. Sekretaris Kabinet; dan 12. Kepala Badan Koordinasi Penanaman Modal. C. Sekretaris: Sekretaris Kemenko Perekonomian.

“Menko Perekonomian selaku Ketua Satuan Tugas Nasional melaporkan pelaksanaan tugasnya kepada Presiden secara berkala pada minggu kedua setiap bulan atau sewaktu-waktu apabila diperlukan,” bunyi Pasal 4 ayat (3) Perpres ini.

Menurut Perpres ini, Satuan Tugas Nasional dalam pelaksanaan tugasnya dibantu oleh Tim Pelaksana, yang tugas dan keanggotaannya ditetapkan oleh Menko Perekonomian selaku Ketua Satuan Tugas Nasional.

Selain itu, untuk membantu tugas Satuan Tugas Nasional dibentuk Manajemen Pelaksana oleh Menko Perekonomian selaku Ketua Satuan Tugas Nasional. Manajemen Pelaksana ini berkedudukan di Kemenko Perekonomian, dikoordinasikan oleh Sekretaris Kemenko Perekonomian.

Dalam rangka pelaksanaan tugas Manajemen Pelaksana tu, Sekretaris Kemenko Perekonomian dapat merekrut tenaga ahli perseorangan dan/atau badan usaha sesuai dengan kebutuhan, dan untuk Tahun Anggaran 2017 ini dapat dilakukan melalui penunjukan langsung.

“Segala biaya yang diperlukan dalam pelaksanaan tugas Satuan Tugas Nasional, Tim Pelaksana dan Manajemen Pelaksana dibebankan kepada APBN Kemenko Perekonomian dan sumber pendanaan lainnya yang sah,” bunyi Pasal 7 Perpres ini.

Tingkat Kementerian/Lembaga

Dalam Perpres ini disebutkan, setiap Kementerian/Lembaga (K/L) yang mempunyai kewenangan Perizinan Berusaha membentuk Satuan Tugas Kementerian/Lembaga

Satuan Tugas ini dapat berfungsi sebagai: a. leader  dalam hal Perizinan Berusaha merupakan kewenangan menteri/kepala lembaga yang bertanggung jawab untuk melakukan pembinaan, pengembangan usaha, dan pelayanan Perizinan Berusaha pada sektor yang menjadi kewenangan menteri/kepala lembaga tersebut; dan/atau b. Pendukung (supporting) dalam hal Perizinan Berusaha merupakan kewenangan menteri/kepala lembaga yang memberikan pelayanan Perizinan Berusaha yang diperlukan oleh menteri/kepala lembaga yang lain, gubernur, dan/atau bupati/wali kota yang berfungsi sebagai utama (leader) dalam rangka menerbitkan Perizinan Berusaha.

Satuan Tugas Kementerian/Lembaga yang berfungsi sebagai leader, menurut Perpres ini mencakup: a. Kementerian ESDM; b. Kementerian Pertanian; c. Kementerian Lingkungan Hidup dan Kehutanan; d. Kementerian Pekerjaan Umum dan Perumahan Rakyat; e. Kementerian Kelautan dan Perikanan; f. Kementerian Kesehatan; g. Kementerian Perindustrian; h. Kementerian Perdagangan; i. Kementerian Perhubungan; j. Kementerian Komunikasi dan Informatika; k. Kementerian Keuangan; l. Kementerian Pariwisata; m. Kementerian Pendidikan dan Kebudayaan; dan n. Kementerian lainnya yang ditetapkan oleh Satuan Tugas Nasional.

Untuk Satuan Tugas Provinsi, menurut Perpres ini, dipimpin oleh Sekretaris Gubernur, dan untuk Satuan Tugas Kabupaten/Kota dipimpin oleh Sekretaris Daerah Kabupaten/Kota.

Mendagri : Ada Putusan Inkracht Baru Bisa Angkat Plt Bupati (Terkait BupKukar Tersangka)

JAKARTA , 03 Oktober 2017 14:14:05– Kementerian Dalam Negeri (Kemendagri) belum bisa menunjuk pelaksana tugas (Plt) bupati Kutai Kartanegara karena  Bupati Rita Widyasari baru ditetapkan sebagai tersangka oleh Komisi Pemberantasan Korupsi (KPK), namun tak ada penahanan kepada yang bersangkutan.

Menteri Dalam Negeri (Mendagri) Tjahjo Kumolo mengatakan, kalau kasus ini merupakan operasi tangkap tangan (OTT) dan langsung ditahan, maka Kemendagri tentu akan menyiapkan langkah hukum dan selanjutnya  akan memberhentikan sementara dan mengangkat Plt Bupati.

“Kalau dia ditahan, karena OTT maka diberhentikan sementara. Tapi Ibu Rita kan tersangka jadi dia bisa melaksanakan tugas sehari hari sebagai kepala daerah sampai nanti menunggu hukum tetap. Kalau ditahan, otomatis kami ganti (angkat Plt),” kata Tjahjo di Kantor Kemendagri, kemarin.

Rita diduga menerima suap terkait izin perkebunan kelapa sawit dan gratifikasi sejumlah proyek di daerahnya. Namun Mendagri menyatakan, dalam penetapan tersangka ini, pemerintah tetap harus memperhatikan asas praduga tak bersalah sampai ada putusan hukum tetap (inkracth).

Berbeda halnya dengan sejumlah kepala daerah yang sebelumnya terjerat OTT KPK dan langsung ditahan, dalam hal ini Pemerintah melalui Kemendagri  langsung membuat surat penetapan Pelaksana tugas untuk menggantikan pejabat Kepala Daerah tersebut. Umumnya  dilaksanakan oleh wakil kepala daerah.

“Menteri, gubernur, bupati, wali kota itu kalau dia OTT dan ditahan, ia diberhentikan sementara sampai putusan inkracht. Kalau OTT dan ditahan ya pasti diganti,” ujar dia.

Test sessions for the 2017/2018 season have been announced, with action getting underway in Valencia in November following the season finale – and 2018 then firing up at the end of January at Sepang International Circuit in Malaysia.

In season tests after races will take place at Catalunya, Jerez y Brno.

Maverick Viñales (Movistar Yamaha MotoGP) has taken pole position for the Gran Premio Movistar de Aragon, exactly a tenth of a second ahead of Jorge Lorenzo (Ducati Team) at the front as compatriot and key title rival Marc Marquez (Repsol Honda Team) tumbled out of contention. There was more headline news as Valentino Rossi (Movistar Yamaha MotoGP) added another chapter to his incredible comeback, qualifying on the front row in third after missing only one event following his leg injury.

Under blue and sunny skies at the stunning MotorLand Aragon, FP3 had seen a shootout for Q2 entry that lit up the timesheets, and Jorge Lorenzo was the high profile name left to head through Q1. But the five-time World Champion easily moved through, subsequently qualifying on the front row.

Cal Crutchlow (LCR Honda) was the man to lose out late on as he was pushed down to fourth, but the two-time GP winner remains top Independent Team rider. Reigning Champion Marc Marquez, despite his crash – rider ok – will start in the middle of the second row, which is completed by teammate Dani Pedrosa (Repsol Honda Team).

Andrea Dovizioso (Ducati Team) had a solid session to take seventh and will be looking to move forward and track Championship rival Marquez, with Aleix Espargaro (Aprilia Racing Team Gresini) impressing in P8 at the venue where he took his first premier class podium. Alvaro Bautista (Pull&Bear Aspar Team) lines up ninth despite a crash, with Andrea Iannone (Team Suzuki Ecstar) taking P10.

Johann Zarco (Monster Yamaha Tech 3) was eleventh quickest after moving through Q1, with Mika Kallio (Red Bull KTM Factory Racing) lining up in P12 as he wildcards and impresses once again. Jack Miller (EG 0,0 Marc VDS) missed out on Q2 by only thousandths and starts P13, with Pol Espargaro (Red Bull KTM Factory Racing) and Karel Abraham (Pull&Bear Aspar Team) locking out the fastest fifteen for the grid.

Now it’s time to race, with equal points at the top between Marquez and Dovizioso – both of whom start off the front row – Rossi fighting through the pain barrier, and Viñales ready to strike from pole.

“US marks 9/11 anniversary with resolve, tears and hope”

On the 16th anniversary of 9/11, AP reports on the personal stories and ceremonies taking place today. Rob Fazio has come to the place where his father, Ronald Carl Fazio, and thousands of others died September 11th. “‘I’ll come every year for the rest of my life,’ the son said. ‘It’s where I get my strength.’” President Trump spoke at the Pentagon telling extremists that “America cannot be intimidated,” and Vice President Mike Pence delivered remarks at the Flight 93 National Memorial near Shanksville, Pennsylvania.

The New York Post editorial board praises the President’s deal with Congressional leaders to shift the debate over the debt limit and government funding to later in the year, saying “Trump avoided having Washington locked in another inside-baseball battle when so many Americans are suffering” from Hurricane Harvey and Irma.

In The Washington Times, economist Stephen Moore highlights the progress the economy has made on growth, jobs, and wealth creation since the election, saying that the President “has shifted the economy and wealth creation into a faster gear” by ending “Washington D.C.’s war against business.”

The New York Times features President Trump’s “fundamental repurposing of the federal bureaucracy to promote conservative social priorities.” Among those issues the President is taking aim at, are allowing more firearms on federal lands, eliminating funding to international groups that provide abortions, and cracking down on sanctuary cities.

As the Election Integrity Commission meets tomorrow, at Fox News, columnist John Fund writes that the new information about out-of-state residents voting in New Hampshire on election day suggests these voters could have affected the outcome of the state’s Senate race and the Presidential election.

Hurricane Irma Update 
President Trump, Vice President Pence, and members of the Cabinet received a briefing yesterday from Acting Homeland Security Secretary Elaine Duke, Federal Emergency Management Agency (FEMA) Administrator Brock Long, and Homeland Security Advisor Tom Bossert on the ongoing Federal response and recovery operations for Hurricane Irma. They also discussed Federal support for Hurricane Harvey recovery, which is still in the early stages. President Trump stressed that his top priorities are life-saving and life-sustaining efforts in affected areas. The President is in regular contact with Governors currently in the path of Hurricane Irma, as well as Governors of the States and territories already impacted by the storm. He continues to extend his thoughts and prayers to those affected, while recognizing the many volunteer and faith-based organizations dedicating their time and efforts to help their fellow Americans.

President Trump Approves Additional Disaster Declarations
Yesterday, President Trump amended the U.S. Virgin Islands Disaster Declaration and authorized an increase in the level of Federal funding for debris removal and emergency protective measures undertaken as a result of Hurricane Irma. The President also declared that a major disaster exists in the Commonwealth of Puerto Rico and the State of Florida, and ordered Federal aid to supplement recovery efforts.

FEMA Resources
Residents and business owners who sustained losses in designated counties can begin applying for assistance by registering online at DisasterAssistance.gov or by calling 1-800-621-FEMA (3362) or 1-800-462-7585 (TTY) for the hearing and speech impaired. The toll-free telephone numbers will operate from 7 a.m. to 10 p.m. (local time) seven days a week until further notice.

Vice President Mike Pence is in Shanksville, Pennsylvania, to commemorate the 16th anniversary of September 11 at the Flight 93 National Memorial. The Vice President will deliver remarks, tour the Flight 93 National Memorial Visitors Center, and participate in a wreath laying ceremony with the friends and family of the fallen.

“Tax cut would bring long-awaited hope and change”

In Fox News, Alfredo Ortiz writes the GOP’s last great hope to save their first year agenda is to pass middle class and small business tax cuts. He supports his claim by citing recent Gallup polling, which shows “significant” middle class tax cuts are supported by a majority of Americans. Mr. Ortiz writes a tax cut “is the most direct way to boost wages,” and provide middle class families relief, in that a tax cut would improve wages by providing small business employers the funds to provide a pay raise. He writes: “Whether your politics are left, right, or center, this is something we can all agree on: More money in more Americans’ pockets is a good thing for everyone.”

In California’s Orange County Register, contributor Joel Fox writes that “cutting taxes for large and small businesses to 15 percent, as President Donald Trump wants to do, puts more resources in the hands of business leaders and entrepreneurs to expand business and create jobs.”

 In immigration news, at American Greatness, contributor Spencer Morrison calls the President’s decision to end DACA “a big win” for “American workers and the rule of law.”

And in The Hill, former House Judiciary Committee staffer and immigration lawyer Nolan Rappaport writes that President Trump ended DACA in the most humane way possible, saying that the President’s decision now places the onus on Congress to deal with this issue.

In regards to judicial nominations, in National Review, contributor Shannen Coffin writes that the President has kept his promise by nominating conservatives to federal judgeships, calling the recent nomination of White House Deputy Counsel Greg Katsas to the D.C. Court of Appeals a “Trump home run.”
